# ShiaNūr — Terms of Service

Please read these Terms of Service (**"Terms"**) carefully before using the
ShiaNūr mobile application (the **"App"**). By downloading, installing or
using the App, you agree to be bound by these Terms. If you do not agree,
do not use the App.
The App is operated by the ShiaNūr team (the **"Developer," "we," "us,"
"our"**).

## 1. The Service
ShiaNūr is a free Shia-focused Islamic devotional application offering:
- A complete Qur'an reader (Mushaf, translations, transliteration, tafsīr,
audio recitation).
- Daily prayer times and Qibla compass.
- The Islamic / Hijri calendar.
- A missed-prayer (Qaḍāʾ) tracker.
- A collection of duas, ziyarat, salawat, ʿamāl and other worship content.
- Tri-lingual interface (English, Arabic, French).
The App is intended **solely for personal, non-commercial devotional use.**

## 2. Eligibility
You may use the App if:
- You are at least 13 years old (16 in jurisdictions where 16 is the
minimum digital age of consent), **or**
- You are using the App under the supervision of a parent or legal
guardian who agrees to these Terms on your behalf.
By using the App you confirm that you meet these requirements.

## 3. Account & authentication
You may use the App anonymously, or you may create an account using:
- Sign in with Apple
- Sign in with Google
- Email and password
If you create an account, you agree to:
- Provide accurate information.
- Keep your sign-in credentials confidential.
- Notify us immediately if you suspect unauthorized access at
**security@shianur.com**.
You are responsible for activity that occurs under your account.
You can **delete your account at any time** inside the App:
**Me → Account → Delete account**. Deletion is irreversible and removes
your synced data within 24 hours (operational backups are purged within 30

## 4. Acceptable use
You agree **not** to:
1. Use the App in a way that violates any applicable law or regulation.
2. Reverse-engineer, decompile, or disassemble the App except to the extent
the law expressly permits.
3. Attempt to gain unauthorized access to our servers, accounts, or any
user data other than your own.
4. Interfere with or disrupt the App, its infrastructure, or the experience
of other users (e.g. excessive automated requests, denial-of-service
attempts).
5. Use the App to harass, defame, or harm others.
6. Misrepresent yourself or impersonate any person or entity.
7. Strip, hide or alter the religious attribution, copyright, or credit
notices contained in the App or its content.
8. Use the App or any of its content for commercial redistribution,
monetization, or as part of a paid product or service without our prior
written permission.
We may suspend or terminate your access if we reasonably believe you have
violated these Terms.

## 5. Religious & devotional content
### 5.1 Sources
The App contains religious texts and translations sourced from classical
Shia works (e.g. *Mafātīḥ al-Jinān*, *Iqbāl al-Aʿmāl*, *Miṣbāḥ al-Mutahajjid*,
*al-Ṣaḥīfa al-Sajjādiyya*, *Biḥār al-Anwār*, *al-Kāfī*), public-domain
Qur'an text (Hafs narration), and devotional recordings shared widely for
free, non-commercial community use.
The App also references the rulings of the Marjaʿiyya, in particular **His
Eminence Sayyid ʿAlī al-Sīstānī** for fiqh-related content. References to
any scholar, marjaʿ, reciter or work are made for **scholarly attribution
only** and **do not imply endorsement, affiliation, or a commercial
relationship** with the App, the Developer, or any third party.
For binding religious rulings (fatāwā), please consult your own marjaʿ. The
App is a study and devotion aid, not a substitute for direct scholarly
guidance.
### 5.2 Reciters
Audio recordings of duas, ziyarat, salawat and aʿmāl have been published
by individual reciters for free, non-commercial devotional use and are
listed in **Settings → Sources → Dua & Ziyarat Reciters**. Where direct
contact was not possible, recordings are included with attribution under the
customary practice of devotional sharing within the community. If you are a
reciter listed in the App and wish to have your recordings removed, please
email **support@shianur.com** (subject: "Reciter takedown") and we will
act promptly.
### 5.3 Limitations
Religious content is provided **as a study aid**. While we make every effort
to source from reliable references, **we make no warranty that any given
translation, transliteration, ruling, time-calculation or interpretation is
free from error**. You are responsible for verifying any matter of religious
significance with qualified scholars and your own marjaʿ.

## 6. Prayer times, Qibla & Hijri calendar
Prayer times, Qibla direction and Hijri-calendar dates are calculated using
algorithmic methods (Umm al-Qura tables with Sayyid al-Sīstānī's
Fajr/ʿIshāʾ angle methodology of 16°–18°, and magnetic-compass / GPS
data). These calculations depend on the accuracy of your device's clock,
sensors and location and on the underlying astronomical algorithms.
**You should not rely on the App as the sole source of truth for time-
sensitive religious obligations.** Where any doubt exists, verify with your
local mosque, marjaʿ or a trusted ruʾyat al-hilāl committee.
We are not liable for prayer-time miscalculations or compass errors caused
by device sensor inaccuracy, magnetic interference, incorrect location or
algorithmic limitations.

## 7. Intellectual property
### 7.1 The App itself
The App's source code, UI design, brand name **"ShiaNūr,"** logo, written
narrative, in-house calligraphic assets and original illustrations are the
intellectual property of the Developer and are protected by copyright and
related rights. You receive a **personal, non-exclusive, non-transferable,
revocable license** to install and use the App on devices you own or control
for your own personal, non-commercial devotional use.
### 7.2 Third-party content
- **Qur'anic text:** public-domain Hafs narration.
- **Translations & transliterations:** published under permissions granted
to the Developer or sourced from public-domain / community-reviewed
bodies. Credits are listed inside the App (**Me → About → Quran Settings
→ About**).
- **Classical Shia works:** in the public domain; modern editions are cited
for scholarly attribution.
- **Audio recordings:** distributed for free, non-commercial devotional
use; attribution is provided inside the App.
If you believe content in the App infringes your rights, please email
**support@shianur.com** (subject: "IP / copyright notice") with full
details and we will respond promptly.
### 7.3 Your content
Anything you generate inside the App that is stored only on your device
(notes, bookmarks, etc.) remains yours. By syncing it to your account you
grant us a limited license to host and process it solely for the purpose of
providing the App's sync feature.

## 8. Modifications to the App
We may modify, suspend, or discontinue the App or any feature, at any time,
with or without notice. We are not liable to you for any modification,
suspension, or discontinuation, except where the law requires otherwise.

## 9. Disclaimers
THE APP IS PROVIDED **"AS IS" AND "AS AVAILABLE"** WITHOUT WARRANTY OF ANY
KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR
RELIABILITY OF CONTENT, PRAYER-TIME CALCULATIONS, QIBLA DIRECTION,
HIJRI-CALENDAR DATES, OR AUDIO PLAYBACK.
YOU USE THE APP AT YOUR OWN RISK. THE DEVELOPER IS NOT A RELIGIOUS
AUTHORITY AND DOES NOT ISSUE FATĀWĀ.

## 10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE DEVELOPER, ITS
AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL,
CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF
PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH
YOUR USE OF, OR INABILITY TO USE, THE APP.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE
OF THE APP WILL NOT EXCEED **TEN EURO (€10.00)** OR THE EQUIVALENT IN YOUR
LOCAL CURRENCY.
Some jurisdictions do not allow the exclusion of certain warranties or
limitations on liability, so some of the above may not apply to you. In
those jurisdictions, our liability is limited to the greatest extent
permitted by law. Nothing in these Terms excludes our liability for fraud,
gross negligence, or any other liability that cannot be excluded by law.

## 11. Indemnification
You agree to indemnify and hold harmless the Developer and its affiliates
from any claim, demand, loss, liability or expense (including reasonable
attorneys' fees) arising out of:
- Your breach of these Terms.
- Your misuse of the App.
- Your violation of any law or any third-party right.

## 12. Termination
You can stop using the App at any time by uninstalling it and/or deleting
your account.
We may terminate or suspend your access immediately, without prior notice,
if we reasonably believe you have violated these Terms or applicable law.
Upon termination, the rights granted to you under these Terms cease, and
provisions that by their nature should survive (intellectual property,
disclaimers, limitations of liability, indemnification, governing law) will
survive.

## 13. Apple-specific terms
If you obtained the App from the Apple App Store, the following additional
terms apply:
- These Terms are between you and the Developer, not Apple. Apple is not
responsible for the App or its content.
- The license is limited to use on Apple-branded devices you own or control
and as permitted by the Apple Media Services Terms.
- Apple has no obligation to provide maintenance or support.
- In the event of any failure to conform to a warranty, you may notify
Apple, and Apple will refund the purchase price (the App is free).
- Apple is not responsible for product liability, third-party claims or
intellectual-property infringement claims related to the App.
- You represent that you are not located in a country subject to a US
government embargo and are not on a US prohibited-party list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms
and may enforce them against you.

## 14. Google Play-specific terms
If you obtained the App from Google Play, your use is also subject to the
Google Play Terms of Service. Google is not a party to these Terms.

## 15. Governing law & dispute resolution
These Terms are governed by the laws of **the Lebanese Republic**, without
regard to its conflict-of-laws principles, except where overridden by
mandatory consumer-protection laws of your country of residence.
The parties will attempt to resolve any dispute informally by contacting
**support@shianur.com** first. If a dispute is not resolved within 60 days,
either party may bring an action in the competent courts of **Beirut,
Lebanon**, except where local consumer law grants you the right to sue in
your own jurisdiction.
If you are a consumer in the European Union, you may also use the European
Commission's online dispute-resolution platform:

## 16. Changes to these Terms
We may update these Terms from time to time. If we make a material change,
we will update the "Last updated" date and show an in-App notice the next
time you open the App. Continued use of the App after a change means you
accept the updated Terms.

## 17. Miscellaneous
- **Severability.** If any provision is held invalid or unenforceable, the
remaining provisions remain in full force.
- **No waiver.** Our failure to enforce any right is not a waiver of that
right.
- **Assignment.** You may not assign these Terms. We may assign them to an
affiliate or successor.
- **Entire agreement.** These Terms, together with our Privacy Policy,
constitute the entire agreement between you and the Developer regarding
the App.
